ADA ENFORCEMENT

CDR’s Chris Hilderbrant and Olinsky Law Group’s Mr. Howard Olinsky Esq., based in Syracuse, New York, have announced a joint endeavor to encourage enforcement of the “Americans with Disability Act” within the Rochester, New York area.

Center for Disability Rights and Olinsky Law Group Announce Partnership for Americans with Disabilities Act Enforcement
Rochester, NY – Today, on the 22ndanniversary of the signing of the Americans with Disabilities Act, the Center for Disability Rights (CDR) and the Olinsky Law Group announced a new partnership to enforce the Americans with Disabilities Act (ADA). This partnership is unprecedented in the Greater Rochester Area. Signed into law on July 26, 1990, by President George H. W. Bush, the ADA is the principle civil rights legislation for people with disabilities in the United States.
The ADA guarantees people with disabilities protection from discrimination in employment, public entities and transportation, public accommodations, and telecommunications. The ADA and its implementing regulations and guidelines also explain the requirements placed on businesses and governments in order to successfully comply with the ADA. Despite these guarantees, implementation and enforcement of the ADA still trail behind the expectations of the disability community.
“People with disabilities continue to face discrimination on a daily basis,” said Bruce Darling, President/CEO of CDR. “While our advocacy has improved many systems, there has continued to be a need for legal enforcement in the courts.”
Lawsuits filed under the ADA are not entitled to damages, so the financial motives for plaintiffs and attorneys are minimal. ADA lawsuits can result in elimination of the barrier or discrimination encountered and payment of attorney’s fees to the plaintiff’s attorney.
The Olinsky Law Group contacted CDR through a shared contact and after one meeting it was clear that the two organizations had a shared interested in creating enduring systems change that would improve the lives of people with disabilities in the Greater Rochester Area. “It was the most exciting meeting I’ve had in years,” said CDR Chief Operating Officer, Chris Hilderbrant. “We see the same problem and the same solution. What makes this really great is that Mr. Olinsky has attorneys looking for plaintiffs and CDR has plaintiffs looking for attorneys.”
The Olinsky Law Group and CDR expect to start with cases of more obvious ADA violations and progress to more complicated systemic cases. CDR and the Olinsky Law Group will be providing a Top 10 Common ADA violations session on July 26, 2012, at 3:00 pm. Materials will be circulated to the public immediately following the session. The organizations will also be providing a session on August 16, 2012, to encourage small business compliance without litigation.

Center for Disability Rights to Make Major Announcement on the Anniversary of the Americans with Disabilities Act
Rochester, NY – The Center for Disability Rights will make a major announcement regarding local enforcement of the Americans with Disabilities Act (ADA) on July 26, 2012. This is the 22nd Anniversary of the signing of the ADA. Signed into law by President George H. W. While the ADA has been a tremendous success in many regards, advocates across the nation have been disappointed with the enforcement of the ADA. The Center for Disability Rights has made ADA enforcement a priority for many years and is very excited to announce a new initiative to further enforce the ADA in the Greater Rochester Area.
