Center for Disability Rights Applauds Court Decision on Companionship Rules
The Center for Disability Rights (CDR) applauds today’s ruling vacating the Department of Labor’s Companionship Rule. This decision ensures that people with disabilities will not lose their attendants to an unfunded mandate. The rule, which was implemented despite the concerns raised by the Disability Community and without sufficient time for states to fund these changes in their Medicaid programs, has caused uncertainty and grave concern for people who use attendant services. Although the Department of Labor could appeal this ruling, CDR hopes they will use this opportunity to address the concerns of the Disability Community that the rules as written and implemented would have serious unintended consequences for attendants and attendant service users.
