Determination mixed with Negotiation equals 90% of Counties on Annual Verification List

Over the past year and a half there has been an ongoing initiative conducted by the Center for Disability Rights, Inc. Community Supplemental Needs Trust related to Verification of Deposit into Pooled Trusts. As stated in the Second Addendum to the Eighth New York State Department of Health Administrative Directive issued in 1996 “verification that the income was placed into the trust is required. In order to eliminate the need to verify this on a monthly basis, it is recommended that you advise the recipient to divert the income directly to the exception trust.” The goal of this initiative has been to ensure as many counties as possible follow a form of Annual Verification thereby ensuring the consumers Medical Assistance benefits are not jeopardized.

As of July 29, 2014 the hard efforts of the Advocacy division of the Center for Disability Rights Pooled Trust Department has confirmed that there have been 56 out of 62 counties adopting a form of Annual Verification equaling 90% of the entire districts.  The following is a detailed list of all the counties confirmed to have adopted a form of Annual Verification:

Our office will do their very best to get as close to 100% of the counties on a form of Annual Verification as possible.  Currently the closest our office will get to in achieving this goal would be 97% because at least 2 counties have voiced strong opposition towards all forms of Annual Verification insisting verifying the proof of deposit on a monthly basis is in the consumer(s) best interest.  Because of this attitude expressed stronger by certain counties more so than others, this advocacy initiative began resulting in 90% standing with us and the consumers we equally serve.  The collaboration struck between the above listed counties and our office is greatly appreciated and we remain hopeful the remaining counties reconsider their position thereby moving to a form of Annual Verification.
